Defendant's acts as a public school teacher and administrator in giving favors forbidden by school rules to minor female students and obtaining from them consensual sexual contact were acts in excess of his lawful authority or which he knew he was forbidden by law to do in his official capacity within the meaning of Minn. Stat. Â§ 609.43(2) (1984). The trial court did not err in denying the motion to dismiss the complaint for lack of probable cause. 2.
